Terms of Service

These are the rules for using nSpace, a consumer app operated by NextTry. By creating an account, you agree to them. We have tried to keep them short and honest.
Who can use nSpace
You need to be at least 16 years old to create an account. If you are between 16 and 18, you may use NextTry only with the permission of a parent or guardian, who agrees to these terms on your behalf. You also need to be honest about who you are. No impersonating other people, no fake accounts. If you are using NextTry on behalf of a business, you are responsible for what that account does.
Your account
You are responsible for what happens on your account. Keep your sign in safe. Do not share your password, and use a strong one (or sign in with Google, which we recommend). If you suspect someone has accessed your account, sign out from Settings and email us at hakest@nexttryhk.com right away.
What you can post
Most things, with limits. We rely on you to keep nSpace a quiet, kind place. The following are not allowed:
- Harassing, threatening, or doxxing anyone.
- Illegal content (under Hong Kong law or the law where the content is shared).
- Sexually explicit content, including non consensual imagery.
- Malware, phishing, or content designed to harm peoples devices.
- Impersonating someone else, including us.
- Spam, mass messaging, or unsolicited promotion.
- Scraping the service, reverse engineering it, or using it through automated means we have not authorised.
- Content that infringes copyright, trademark, or other intellectual property you do not own or have rights to use.
We may remove content or suspend accounts that violate these rules. For serious violations, we may act without prior notice.
Your content
You own everything you post on NextTry, your moments, photos, messages, profile, and so on. By posting, you grant us a non exclusive, worldwide, royalty free licence to host, store, transmit, and display that content to the audience you chose (your accepted connections for moments, your conversation partner for messages). This licence ends when you delete the content. We do not use your content to train AI models or for any purpose beyond running the service for you.
Reporting and moderation
You can report any moment from its menu. We review reports in good faith and remove anything that violates these terms. If we remove your content or suspend your account, we will tell you why and, where appropriate, give you a chance to respond.
Service availability
NextTry is provided “as is”. We strive for high uptime, but we do not guarantee uninterrupted service. We may add, change, or remove features. Where we are removing or significantly changing something you depend on, we will do our best to give notice.
Termination
You can delete your account any time from Settings → Danger zone. We may suspend or terminate your account if you violate these terms, usually after notice, but immediately for serious violations (harassment, illegal content, abuse of the service).
When your account is deleted, your profile, moments, photos, messages, meetups, and connections are removed across all related tables. Backups may take longer to age out, in accordance with our backup retention.
Limitation of liability
To the maximum extent permitted by law, NextTry, its owners, and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the service. Our total liability to you for any claim arising from these terms or your use of NextTry is limited to the amount you paid us in the 12 months before the claim. For free users, that is HK$0.
This does not exclude any liability that cannot legally be excluded under Hong Kong law.
Indemnification
You agree to indemnify and hold NextTry harmless against any third party claims (including reasonable legal fees) arising out of: (a) content you post, (b) your use of the service, or (c) your violation of these terms or any law. We will let you know promptly of any claim and let you participate in the defence.
Governing law and disputes
These terms are governed by the laws of the Hong Kong Special Administrative Region. Any dispute that we cannot resolve directly will be brought before the courts of Hong Kong, and you and we both agree to their exclusive jurisdiction.
Severability and entire agreement
If any part of these terms is found unenforceable, the rest still applies. These terms, together with our Privacy Policy and Cookie Policy, form the entire agreement between you and NextTry. Anything else (informal chats, support emails, marketing copy) is not part of the agreement.
Changes to these terms
We will let you know about meaningful changes through an in app notice and an email at least 30 days before they take effect. Minor edits (typos, clarifications) may go live without notice. The “Last updated” date at the top will always reflect the current version.
